The IHG® Rewards Club programme ("Programme") membership and its benefits are offered at the sole discretion of Six Continents Hotels, Inc. (“SCH”) and its subsidiaries and affiliates that are members of the InterContinental Hotels Group (collectively “IHG”). Hotel brands currently participating in the Programme include InterContinental®, Hualuxe® Hotels and Resorts, Crowne Plaza®, Hotel Indigo®, EVEN® Hotels, Holiday Inn®, Holiday Inn Express®, Holiday Inn Resort®, Holiday Inn Club Vacations®, Staybridge Suites®, and Candlewood Suites® (collectively, “IHG Hotels”). Brands may be added or deleted at the sole discretion of SCH. The Flights Anywhere benefit is solely for IHG® Rewards Club members who log in to the Flights Anywhere website.

SCH has engaged Switchfly, Inc. ("Switchfly"), a third-party provider, to host this private label airline ticket redemption website (the "Site"). Switchfly has engaged Connexions Loyalty Travel Solutions, LLC. ("Connexions" or “CLTS”) to act solely in the capacity as agent for suppliers of air travel to provide members of the IHG® Rewards Club programme ("Members" or "you") with the ability to redeem IHG® Rewards Club points, or a combination of points and currency, for airline tickets through the Site. SCH, Switchfly, and Connexions, together with their subsidiaries and affiliates, and their respective officers, directors, employees, representatives, agents, and licensors, shall be referred to collectively herein as the "Covered Parties".

These terms and conditions (the "Flights Anywhere Terms and Conditions") govern your redemption of IHG® Rewards Club (or points and currency) for airline tickets through this Site and describe your responsibilities regarding such redemption. By redeeming for airline tickets on the Site you agree and warrant that:

you are at least 18 years of age and possess the legal authority to enter into this Agreement;

you have read, understood and accepted these Flights Anywhere Terms and Conditions;

all information supplied by you or members of your household using this Site is true and accurate;

you have read, understood and accepted the IHG® Rewards Club Global Membership Terms and Conditions which are incorporated by reference herein (the "Programme Terms");

you have read, understood and accepted the IHG® Website Terms of Use which are incorporated by reference herein (the "Website Terms of Use"); and

you consent to SCH and its authorised third-party agents processing data that is personal to you, and disclosing such data to third parties (such as air travel suppliers), in accordance with the Flights Anywhere Privacy Policy;

If you do not agree with any of the foregoing, do not redeem for airline tickets in the Flights Anywhere programme.

These Flights Anywhere Terms and Conditions shall control to the extent of any conflict with the Programme Terms and the Website Terms of Use, and may be amended at any time by SCH posting amended terms and conditions on the Site. Any such amended Flights Anywhere Terms and Conditions shall become effective upon posting.

USE OF SITE. In addition to the general provisions for website use set forth in the Website Terms of Use, you agree that: 

you will only use the Site to redeem for legitimate travel tickets for you or for another person for whom you are legally authorised to act

you are responsible for any error in the accuracy of information provided in connection with this Site; and

you will inform any other individuals for whom you purchase tickets of these Flights Anywhere Terms and Conditions;

you are responsible for all charges, fees, duties, taxes, and assessments arising out of the use of this Site.

REDEEMING FOR FLIGHTS. In addition to the provisions governing redemption of IHG® Rewards Club points set forth in the Programme Terms, you agree that:

Prices and information displayed on the Site, or in related marketing materials for the Flights Anywhere programme, are valid for select departures for a limited time, and are subject to change without notice and may be withdrawn at any time;

IHG® Rewards Club points (or a combination of points and currency) can only be redeemed for the original airline ticket purchase and associated fees and taxes;

any fee(s) that may apply after the initial ticket purchase—including, but not limited to, itinerary changes or cancellations, after-purchase upgrades, baggage fees, or in-flight food and beverages—may not be paid for by redeeming IHG® Rewards Club points. Airline surcharges vary by airline so it is important to read any terms and conditions that the carrier may impose;

once you have redeemed IHG® Rewards Club points for a ticket, they may not be returned to your account under any circumstances; once you have submitted currency as partial payment for a ticket, you will typically not be able to get any of your cash payment refunded;

your overuse and/or abuse of the redemption programme offered by this Site may result in you being denied access to the Site and in the termination of your IHG® Rewards Club membership.

AIRLINE TICKETS & POLICIES. All airline tickets are subject to the published conditions of carriage and rules of the applicable airline. The contract of carriage in use by the applicable airline shall be between the applicable airline and the passenger. 

All flight details should be confirmed with the applicable airline including, without limitation, the schedule of your flight, airline policies, baggage charges, baggage size limitations or restrictions, and any other additional fees that must be paid directly to the applicable airline. Airline schedules change frequently. Please reconfirm all flight dates and times with the appropriate airline 72 hours prior to departure. Airlines reserve the right to change aircraft equipment without notice to Connexions or the passenger. 

SCH and the other Covered Parties maintain no control over the personnel, equipment or operations of any airline. SCH and the other Covered Parties do not guarantee or insure the services provided by any supplier of air travel and will not be responsible or liable for any act, error, omission, injury, loss, accident, damage, delay, non-performance, inconvenience, irregularity or any consequences therefrom, which may be occasioned through the neglect or default, or any other action or inaction by any supplier. 

You agree to abide by the terms and conditions imposed by any supplier with whom you elect to deal and you understand that failure to do so may result in cancellation of your reservation(s) and your being denied access to any flights, and any costs incurred by a Covered Party as a result of such violation.

BANKRUPTCY OR FLIGHT CHANGES, DELAYS OR CANCELLATIONS. SCH and each other Covered Party shall have no liability if a travel provider is not able to honour an airline ticket purchased through this Site for any reason, including, without limitation, bankruptcy proceedings, strikes, labour shortages or flight delays or cancellations.

ITINERARY CHANGES OR CANCELLATIONS. All ticket purchases are final and cannot be cancelled, refunded, exchanged, or transferred. Accordingly, carefully review your ticket purchases for any errors or discrepancies prior to purchase. If you need to make changes to your travel itinerary, please call the applicable customer service number listed on your Flights Anywhere email confirmation. In certain circumstances, changes may not be possible. If changes to the travel itinerary are possible, based on the applicable rules and regulations for the applicable airline, such changes shall be subject to fees charged by the airline and to service fees charged by Connexions. Tickets may not be reassigned or transferred to a different airline. Most airline tickets do not retain any value if not cancelled prior to departure. Connexions will be the merchant of record and will collect and process your payment(s). Transactions will be processed under the name “Trip Charges”.

PASSENGER NAME AND IDENTIFICATION. All airline tickets purchased on the Site must be purchased in the exact name of the person travelling which, to the extent applicable, must be identical to the name that appears on the traveller's passport. Airline passengers must present a government-issued identity card at the airport on the day of travel. Once purchased, tickets are not transferable.

INTERNATIONAL TRAVEL REQUIREMENTS. Many destinations and itineraries require a valid passport. Visa policies vary by country and any necessary visas should be obtained prior to departure. You are responsible for complying with government travel requirements, and presenting exit, entry and other required documents such as passports and visas.

REQUIREMENTS FOR CHILDREN. Children under the age of 18 travelling internationally without one or both of their natural parents must carry a notarised letter of permission from the absent parent or parents. Parents should contact a local notary public for details. You cannot book a ticket on Flights Anywhere for an unaccompanied child under 18.

HAZARDS. SCH and the other Covered Parties have no special knowledge regarding health hazards, political climate, weather hazards, supplier financial information or safety records or foreign entry requirements and do not represent or warrant that travel to any destination is without risk. You can find information on the conditions and potential levels of risk associated with particular destinations by visiting www.state.gov, www.tsa.gov, www.dot.gov, www.faa.gov, www.cdc.gov, www.treas.gov/ofac
and www.cbp.gov.

LIMITATION OF LIABILITY. IN NO EVENT SHALL SCH OR ANY OTHER COVERED PARTY BE LIABLE FOR ANY INJURY, DEATH, LOSS, CLAIM, DAMAGE, ACT OF GOD, ACCIDENT, DELAY, OR ANY SPECIAL, EXEMPLARY, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY KIND, WHETHER BASED IN CONTRACT, TORT OR OTHERWISE, WHICH ARISE OUT OF OR ARE IN ANY WAY CONNECTED WITH ANY USE OF THIS SITE, THESE FLIGHTS ANYWHERE TERMS, REDEMPTION OF IHG® REWARDS CLUB POINTS FOR AIRLINE TICKETS, THE USE OF THE AIRLINE TICKETS OR ANY ASSOCIATED TRAVEL, EVEN IF A COVERED PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Further, except as set forth below, the Covered Parties accept no responsibility for any damage and/or delay due to airline provider cancellations, shortages, sickness, pilferage, labour disputes, bankruptcy, machinery breakdown, quarantine, government restraints, weather, terrorism or causes beyond the Covered Parties' control. No responsibility is accepted for any additional expense, omissions, delays, re-routing or acts of any governmental authority. No Covered Party shall be responsible for any airline provider's breach of any warranty including, but not limited to, implied warranties of fitness for a particular purpose or of merchantability, nor shall any Covered Party be responsible for any other wrongdoing of a Provider (including any liability in tort), as to any products and/or services available through this Site. No Covered Party shall be responsible for any airline provider's failure to comply with these Flights Anywhere Terms and Conditions nor for any airline provider's failure to comply with applicable federal, state, provincial and local law. If, notwithstanding the above, a Covered Party is found liable for any loss or damage relating to the use of this Site, you agree that the liability of any such party shall in no event exceed the amount of IHG® Rewards Club points (or the combination of IHG® Rewards Club points and currency) redeemed for the airline ticket in question. Some states, to the extent their law might be deemed to apply notwithstanding the selection of Georgia law as described below, do not allow the limitation of liability, so the foregoing limitations might not apply to you.

INDEMNIFICATION. You agree to indemnify and hold SCH and the other Covered Parties and their subsidiaries, affiliates, officers, directors, agents and employees harmless from any claim or demand, including reasonable solicitor's fees, made by any third party due to or arising out of your breach of these Flights Anywhere Terms and Conditions or your violation of any law or the rights of a third party. A Covered Party's failure to act with respect to a breach by you or others does not waive its right to act with respect to subsequent or similar breaches.

GOVERNING LAW. Any disputes arising out of or related to your use of this Site, these Flights Anywhere Terms and Conditions, or the Flights Anywhere programme shall be handled individually without any class action, and shall be governed by, construed and enforced in accordance with the laws of the State of Georgia.

ENTIRE AGREEMENT. These Terms and Conditions, together with those incorporated herein or referred to herein, constitute the entire agreement between us relating to the subject matter hereof, and supersede any prior understandings or agreements (whether oral or written) regarding the subject matter, and may not be amended or modified except in writing or by making such amendments or modifications available on this Site.
